BY CLICKING ON "I AGREE" BELOW AND BY USE OF THIS SERVICE YOU ARE CONCLUDING A LEGALLY BINDING AGREEMENT, AND ACKNOWLEDGE RECEIPT OF ALL APPROPRIATE DISCLOSURES. READ CAREFULLY.

INTERNET BANKING AGREEMENT AND DISCLOSURE STATEMENT
This agreement states the terms and conditions that apply when you use our Internet Banking service. You agree to be bound by the terms and conditions of this Internet Banking Agreement and acknowledge its receipt and your understanding to its terms. These terms and conditions are in addition to those that apply to any accounts you have with us or any other services you obtain from us. You also acknowledge receipt of Poplar Grove State Bank’s “Terms & Conditions” and “Electronic Funds Transfer” Disclosures when you opened your account or by direct request from us either in person or by mail. You must also follow all of our instructions and procedures applicable to the services covered by this agreement
DEFINITIONS: "You" and "your” mean each person or officer /employee who establishes an Internet Banking Customer Account with us or who uses or is authorized to use an Internet Banking identification number / user name and password or other means of access we establish or approve. The term "Internet Banking" means our service that allows you to make payments, transfer funds, access accounts, obtain information and perform other transactions over the Internet by use of a personal computer and modem and/or other means we authorize or allow. “We”, “Us” and “Our” mean Poplar Grove State Bank.
IDENTIFICATION NUMBER / USER NAME AND PASSWORD
To access our Internet Banking service, you must use the identification number / username or other means of access we establish or provide for your Internet Banking Customer Account, together with a password. The first time you sign on you may change the identification number to a unique user name and you must change your password. Anyone to whom you give your Internet Banking identification number / user name and password to will have full access to your accounts even if you attempt to limit that person's authority.
ACCOUNTS
You must control any accounts with special instructions such as, requires more than one signature for withdrawals, Power of Attorney, etc. We will not be responsible for any transactions that you process that override these instructions. You must be the owner of the account in order to process a transaction.
INTERNET BANKING TRANSACTIONS
You, or someone you have authorized by giving them your Internet Banking identification number user name and password or other means of access (even if that person exceeds your authority), can instruct us to perform the following transactions:
Make transfers between your qualifying accounts to the extent authorized;
Obtain information that we make available about your qualifying accounts; and
Obtain other services or perform other transactions that we authorize.
We may from time to time introduce new Internet Banking services. By using those services when they become available, you agree to be bound by the terms contained in this Agreement and its subsequent amendments.
LIMITS ON INTERNET BANKING TRANSACTIONS
You must have enough available money or credit in any account from which you instruct us to make a payment or transfer. If any of your qualifying accounts are money market savings accounts, certain types of withdrawals from those accounts, including payments and transfers, are limited to a total of no more than 6 in any specified period. The specified period for money market accounts is the monthly statement period. The kinds of withdrawals covered by this limitation are those made by means of pre-authorized or automatic transfers and payments or telephone agreement. A total of only 3 of these kinds of withdrawals may be made by check, draft, debit card, or similar order payable to third parties.
Transactions will be allowed based on our current availability policy and by any other account policies as disclosed to you.

We will not be held responsible for any transactions processed by someone other than you who you have given your Internet Banking identification / user name and password to.
Officers / employees of a business account agree that any payment order received via our Internet Banking product are secure and can be relied upon by us regardless of who initiated the request.
OUR LIABILITY FOR FAILURE TO COMPLETE PAYMENTS OR TRANSFERS
We will make a reasonable effort to complete a transaction on time or in the correct amount according to our agreement with you. Examples of situations in which we hold no liability for completing transactions include, but are not limited to:
1. If, through no fault of ours, you do not have enough available money in the account from which a payment or transfer is to be made, or if the account has been closed or is not in good standing, or if we reverse a payment or transfer because of insufficient funds.
2. If any payment or transfer would go over the credit limit of any account.
3. If your equipment or ours was not working properly and the breakdown should have been apparent to you when you attempted to conduct the transaction.
4. If you have not given us complete, correct or current account numbers or other identifying information so that we can properly credit your account or otherwise complete the transaction.
5. If you do not properly follow our instructions or if you provide us with wrong or inaccurate information or fail to correct or tell us about any inaccuracy of which you are aware.
6. If you do not instruct us soon enough for your payment or transfer to be received and credited by the time it’s due.
7. If the money in the account from which a payment or transfer is to be made is subject to legal process or other claim restricts the transaction.
8. If circumstances or persons beyond our control prevent, delay, intercept or alter the transaction, despite reasonable precautions that we have taken.
BUSINESS DAYS
Our Internet Banking service is generally available 24 hours a day, 7 days a week. However, we only process transactions and update information on business days. Our business days are Monday through Friday. Transfers made after 3:00 p.m. CST will be processed on the next business day. Holidays are not a business day.
At certain times, some or all of the Internet Banking service may not be available due to system maintenance or reasons beyond our control. We do not warrant that Internet Banking will be available at all times.
STATEMENTS
Your Internet Banking transactions will be indicated on the monthly or quarterly statements we provide or make accessible to you for the Internet Accounts you maintain. You agree to notify us promptly if you change your address or if you believe there are any errors or unauthorized transactions on any statement, or statement information.
YOUR LIABILITY
Each of you agrees, for yourself to the terms of this account & the schedule of charges that may be imposed. You authorize us to deduct these charges as accrued directly from the account balance. You are liable for all transactions that you or any of you make or authorize, even if the person you authorize exceeds your authority, If you have given someone your Internet Banking number / user name and password or other means of access and want to terminate that person's authority you must change your identification number / user name and password or other means of access or take additional steps to prevent further access by such person.
UNAUTHORIZED TRANSACTIONS OR LOSS OR THEFT OF YOUR INTERNET BANKING IDENTIFICATION NUMBER OR PASSWORD
If you believe your Internet Banking identification number / user name or password or other means of access have been lost or stolen or that someone has used them without your authorization, call us immediately at (815) 765-3333 during normal business hours, or write to us at: Poplar Grove State Bank, PO Box 280, Poplar Grove, IL 61065-0280. Quickly telephoning us is the best way of reducing your possible losses. We must hear from you no later than sixty (60) days after we have sent the first statement on which the problem or error appeared (If you notify us verbally, we may require that you send us your complaint or question in writing or electronically within ten (10) business days). If you fail to notify us within the sixty (60) day period, you may not recover any of the money you lost if we can establish that the loss could have been avoided had you notified us on time. We may extend these time periods for good reasons such as out-of-town travel or extended hospital stays.
When you report a problem or discrepancy, please: (1) tell us your name and account number; (2) describe the error or the transaction you are unsure about, and explain why you believe it is in error or what additional information you need; (3) tell us the dollar amount of any suspected error. Generally speaking, we will tell you the results of our investigation within ten (10) business days, or twenty (20) business days in the case of point of sale or international transactions, after we hear from you. However, we may take up to forty-five (45) days, or ninety (90) days in the case of point of sale or international transactions, to investigate your complaint or question. In this case, we may provisionally credit your account so that you have use of the money during the time it takes us to complete our investigation. If you fail to provide your complaint or question in writing within ten (10) business days of a request from us to do so, we reserve the right to not credit your account. If we confirm an error, we will correct your account record within ten (10) business days, or twenty (20) business days in the case of point of sale or international transaction. If we determine that there was no error, we will send you a written explanation within three (3) business days after we conclude our investigation and will debit any interim amounts credited to your account. You may request copies of any documents that we use in our investigation.
EQUIPMENT AND SOFTWARE
You are responsible for the installation, maintenance, and operation of your computer and its software. Poplar Grove State Bank is not responsible for any errors or failures from any malfunction of your computer software. Poplar Grove State Bank is also not responsible for any computer virus or related problems that may be associated with the use of any on-line system including our Internet Banking service. Poplar Grove State Bank highly recommends the use of manufacturer recommended virus detection software.
ELECTRONIC MAIL (E-MAIL)
If you send an e-mail message to Poplar Grove State Bank, DO NOT SEND ANY PERSONAL INFORMATION. We will never ask for your account number, password or any other personal information. E-mails are NOT secure and should not be used to communicate personal details. You may call or write us when the situation requires personal information.

JOINT ACCOUNTS
The provisions of this “Joint Account” section apply if your accounts subject to the service with us are joint. Each of you is jointly and severally obligated under the terms of this Agreement as well as the original Account Agreement(s) governing your joint accounts. Each of you acting alone may perform transactions, obtain information, terminate this Agreement or otherwise transact business, take actions, or perform under this Agreement. We are not required to obtain the consent of, or notify either of you of actions taken by the other. However, each of you will only be permitted to access accounts for which you are an owner or authorized user. Each of you individually releases us from any liability and agrees not to make any claim or bring any action against us for honoring or allowing any actions or transactions where the person performing the action or transaction is one of you or is otherwise authorized to use our Internet Banking service. Each of you agrees to indemnify us and hold us harmless from and against any and all liability (including, but not limited to, reasonable attorney fees) arising from any such claims or actions.

GOVERNING LAW
This agreement and the Internet Banking service are governed by the laws of the State of Illinois, including the applicable provisions of the Uniform Commercial Code and all applicable federal laws and regulations.

Information that we place on the World Wide Web may contain links to other sites and third parties may establish links to our site. We make no representations about any other web site that you may access to, from or through this site. Unless expressly stated in writing, we do not endorse the products or services offered by any company or person linked to this site nor are we responsible for any software or the content of any information published on the site of any third party. You should take precautions when downloading files from sites to protect your computer software and data from viruses and other destructive programs.
INDEMNIFICATION
Customer shall indemnify, defend and hold harmless Poplar Grove State Bank and its officers, employees, directors, suppliers and agents, in their individual capacities or otherwise, from and against any Losses arising out of: (1) Customer’s negligence; (2) Customer’s failure to comply with applicable law; or (3) Customer’s failure to comply with the terms of this Agreement.
ADDITIONAL REMEDIES
Due to the likelihood of irreparable injury, we shall be entitled to an injunction prohibiting any breach of this Agreement by Customer.
WAIVER
We shall not, by the mere lapse of time, without giving notice or taking other action, be deemed to have waived any of its rights under this Agreement. No waiver by us of a breach of this Agreement shall constitute a waiver of any prior or subsequent breach of this Agreement.
FORCE MAJEURE
Neither party shall be liable for any loss nor damage due to causes beyond its control, including fire, explosion, lightning, pest damage, power surges or failures, strikes or labor disputes, water, acts of God, the elements, war, civil disturbances, acts of civil or military authorities or the public enemy, inability to secure raw materials, transportation facilities, fuel or energy shortages, acts or omissions of communications carriers, or other causes beyond that party’s control. Either party may terminate this Agreement immediately on written notice if the other party is prevented from performing its obligations under this Agreement for a period of more than thirty (30) days due to the reasons set forth in this subsection.
