INTERNET BANKING AGREEMENT AND DISCLOSURE
You must be 18 years or older in order to obtain access to an Internet Banking Account with Wayland State Bank. You may either fill out an enrollment request online at waylandstbank.com or in either of our bank locations. If you are under 18 a parent may sign a consent form.
This Internet Banking Agreement and Disclosure governs your use of Internet Banking. Throughout this agreement, the Agreement and Disclosure will be referred to as “Agreement”. By using Internet Banking, you agree to all of the terms of this Agreement. Please read it carefully and retain a copy for your records. In consideration of the Internet Banking Services (“Services”) to be provided by the Wayland State Bank (“Bank”), the words “Customer”, “You”, “Your”, refers to the person(s) subscribing to or using the Service. “We”, “Us”, “Our”, refers to Wayland State Bank and any agent, independent contractor, designee, or assignee the Wayland State Bank may involve in the provision of Internet Banking. “Business Day” refers to any calendar day other than Saturday, Sunday or any holidays recognized by the Wayland State Bank.
At the present time you may use the Internet Banking Services to access your accounts and perform the following functions:
• View Account History (Balances, Activity,) for up to 90 days
• Schedule a one time on line transfer between accounts
• Schedule a recurring transfer between accounts
• Make payment transfers to your Wayland State Loan Accounts
• Download your account history into various financial management software programs
• Email secure mail messages to personnel at the Wayland State Bank
• Access and Download Monthly Statements
Transfers- You may make funds transfers to other accounts of yours as often as you like. Your ability to transfer funds between certain accounts is limited by federal law, as stated in your deposit agreements. Under these regulations, pre-authorized electronic funds transfers from a savings or money market account will be limited to a total of six (6) in any one month. Of these six (6) transactions, you are limited to no more than three (3) transactions per month by check. Each funds transfer or payment through Internet Banking Service from your savings account or money market account is counted as one of the six limited transfers you are permitted each month. You may transfer or withdraw up to the current balance of your account, except as limited under this Agreement or your deposit or loan agreements. You may not be allowed to make transfers from accounts that require two or more signatures for withdrawals. By requesting us to make a transfer through the use of the Services, you are authorizing us to complete that transfer without the necessity of further instruction or signature by you and deduct the amount of the transfer from your relevant deposit account. The Access ID and Password you use to gain access to the Services and request transfers acts as your signature.
Transactions- We reserve the right to refuse any transactions that would draw upon insufficient or unavailable funds, lower an account below a required balance or otherwise require us to increase our required reserve on the account.
Account Information- The account balance and transaction history information will be limited to recent account information involving your accounts. The availability of funds for transfer or withdrawal may be limited by when transactions post throughout the day or by our Funds Availability Policy. Our policy is to make funds available to you on the same business day you deposit. If you make a transfer before 4:00 p.m. CST we will consider that to be the day of your transfer. If you make a transfer after 4:00 p.m. CST we will consider that the transfer was made on the next business day we are open.
Right to stop payment and procedure for doing so - If you have told us in advance to make regular payments out of your account you can stop any of these payments. Here is how: call us at 319-256-5000, 319-257-3305, 319-385-8189 or inquire in writing to 205 West Main Street, Wayland Iowa 52654 in time for us to receive your request three business days or more before the payment is scheduled to be made. if you call we may also require you to put your request in writing and get it to us within 14 days after you call. Liability for failure to stop payment of preauthorized transfer - if you order us to stop one of these payments three business days or more before the transfer is scheduled, and we do not do so we will be liable for your losses or damages.
FINANCIAL INSTITUTION'S LIABILITY
if we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damges. however, there are some exceptions. we will not be liable for instance:
if, thorugh no fault of ours, you do not have enough money in your account to make the transfer.
if you have an overdraft line and the transfer would go over the credit limit.
if circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken.
Internet Banking customers may use general e-mail from our web site for non-urgent communications with us. You should not rely on e-mail for important or time-sensitive notices to us such as reporting lost or stolen PIN, Password, credit or debit card, for reporting an unauthorized transaction from your account(s), or for giving us billing error notices. E-mail request will not be used to request transfers from your accounts.
PERIODIC STATEMENTS AND SERVICES
Services will generally be available 24 hours a day, seven days a week. Services may be unavailable at times for security reasons, system updates, and problems with transmission or for other reasons. Any transactions conducted on the Internet Banking will appear on you periodic statements.
CHANGE IN TERMS AND NOTICES
We reserve the right to change the terms and conditions upon which this service is offered. We may add, delete or amend terms, conditions and other provisions, fees, charges and other terms described in this Agreement. We will send you a notice provided by your and /or send notice to your email address, as requested by you, at least thirty (30) days before the effective date of changes as required by law.
FEES AND CHARGES
There is a $2.00 monthly fee for Internet banking, which is waived if you continue to have you monthly statements delivered via internet banking. We reserve the right to change the terms and conditions upon which this service is offered. We may add, delete or amend terms, conditions and other provisions, fees, charges or other terms described in the Agreement. We will send you a notice to the postal address provided by your and/or send notice to your e-mail address, as requested by you, at least thirty days before the effective date of any changes, as required by law. Use of the Internet Banking Service is subject to existing terms and regulations governing your account and any future changes to those terms and regulations.
By accessing the Services, you hereby acknowledge that you will be entering a protected web site owned by the Bank, which may be used only for authorized purposes. The Bank may monitor and audit usage of the System, and all persons are herby notified the use of the Services constitutes consent to such monitoring and auditing. Unauthorized attempts to upload information and /or change information on these web sites are strictly prohibited and are subject to prosecution under the Computer Fraud and Abuse Act of 1986.
TERMINATION OF INTERNET BANKING SERVICES
You agree that we may terminate this Agreement and your use of the Internet Banking Services if you or any authorized user of your account or access code breaches this or any other agreement with us; or if we have reason to believe that there has been an unauthorized use of your account or access code. You can terminate this agreement by notifying us in writing. Termination of services will be effective the first business day following receipt of your written notice. However, terminations of this Agreement will not affect the rights and responsibilities of the parties under this Agreement for transactions initiated before termination.
YOUR ACCESS ID AND PASSWORD
Each individual requesting access to Internet Banking will receive his or her own 16 digit password. Passwords will be given out after submitting the agreement on our website or written approval. Once gaining access to the system, individuals will be required to change their ID and password. Bank personnel will not have access to any passwords, and will only be allowed to clear or reset password under authorization from you. You must keep your ID and PIN. If you give out your ID and PIN to someone else, you are authorizing them to act on your behalf, and we may accept any instructions they give to us while logged on to Internet Banking. Wayland State Bank will never call and ask for you ID and Pin, or for any other personal information from you. If you receive any calls from a party requesting information regarding your private information, please notify the bank staff immediately. If you believe that you ID and PIN has been lost or stolen please call us as soon as possible and we will cancel and reissue you password.
ERROR OF RESOLUTION NOTICE
In case of errors or questions about your Internet Banking transaction please contact us as soon as possible. We must hear from you no later than sixty (60) days after we sent the FIRST statement on which your problem appears. The statue of limitations governing these responsibilties will commence at the time you receive the email notification that your statement is available.
OUR INTERNET WEB SITE
Visitors to the Wayland State Bank Website, www.waylandstbank.com, will remain anonymous. We do not collect personal identifying information about site users, unless you choose to provide such information to us. Information is not disseminated or sold to other organizations.
Wayland State Bank is not responsible for any electronic virus or viruses that you may encounter. We are not liable for any damage to any of your equipment or software you may have. We are not responsible for upgrading your equipment to stay current with the Services nor are we responsible for any data residing on it. We encourage customers to routinely scan their PC’s using a reliable virus product to detect and remove viruses. Undetected viruses that destroy programs or retrieve information off of your equipment will not be liable to the Bank.
The laws of the state of Iowa shall govern this agreement and all transaction hereunder. Customer acknowledges that he/she has reviewed this Customer Agreement, understands the terms and conditions set forth herein, and agrees to be bound by them. No waivers of the terms of this Agreement will be effective, unless in writing and signed by an officer of this Bank. You may not transfer or assign your rights or duties under this Agreement.
Customer, in consideration of being allowed access to the Services, agrees to indemnify and hold the Bank harmless for any losses or damages to the Bank resulting from the use of Services, to the extent allowed by applicable law.
ELECTRONIC STATEMENTS AND DISCLOSURES
upon enrollment in internet banking, You will receive your Periodic statements and discloures (including but not limited to regulatory disclosures, marketing information, confirmations, or changes to the accounts as applicable) electronically via internet banking. If you do not wish to receive your periodic statements or disclosures in such a manner you are required to notify the bank within 10 business days before you wish to terminate in writing to: 205 west main street, wayland, iowa, 52654. you may also visit either location. if you wish to have your statements mailed to you while you are enrolled in internet banking you will be subject to the $2.00 internet banking fee.
To receive your statements electronically, you will need a computer that satisfies the minimum web browser requirements for internet banking. you will also need a printer or the ability to download the information for your records. Statements will be available for 545 days. it is your responsibility to save the statements in a form you wish to retain them.

YOUR ELECTRONIC STATEMENT WILL BE DISCONTINUED IF YOUR EMAIL ADDRESS COMES BACK AS UNDELIVERABLE. you are responsible for providing us with updated contact information such as change in email address.
